1. Provider and Scope

The nicheace.eu website (the “Site”) is operated and provided by Moelsen Operations Ltd, a company registered in the United Kingdom (registered office: 124 City Road, London EC1V 2NX, United Kingdom; Companies House no. 17336104) (the “Provider”, “we”, “us”). The Site is a marketing website that presents the nicheAce products. The mobile applications (“language”, “playground+”) are not yet available and will be distributed via third-party stores under their own terms.

By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to gain unauthorized access to any systems, accounts, or data;
• Interfere with or disrupt the Site, its servers, or its infrastructure;
• Transmit any malicious code, viruses, or harmful content;
• Use automated systems (bots, scripts, scrapers) to access the Site without authorization; or
• Violate any applicable local, national, or international law.

3. Intellectual Property

All content, features, and functionality of the Site — including the names “nicheAce”, “language”, and “playground+” — are owned by Moelsen Operations Ltd and are protected by copyright, trademark, and other applicable laws.

You may not reproduce, distribute, modify, publicly display, or commercially exploit any of our content without prior written permission, except to the extent permitted by law.

4. Third-Party Links and Services

The Site may contain links to external services, including app-distribution stores such as Google Play and the Apple App Store. Once you leave nicheace.eu, the terms, conditions, and privacy policies of those external services apply. We have no control over and assume no responsibility for the content or practices of third-party sites.

5. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the extent permitted by applicable mandatory law, we do not warrant that the Site will be uninterrupted, error-free, or completely secure, nor do we guarantee the accuracy, reliability, or completeness of any content.

This section does not affect any statutory rights you may have, in particular as a consumer under German and EU law.

6. Limitation of Liability

To the extent permitted by applicable mandatory law, Moelsen Operations Ltd shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising out of your use of the Site.

This limitation does not apply to liability for intentional or grossly negligent conduct, for injury to life, body, or health, or for any liability that cannot be excluded or limited under mandatory German or EU consumer-protection law. Where you are a consumer, your statutory rights remain fully unaffected.

7. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Site at any time, and to update these Terms. Material changes to these Terms will be reflected by updating the “Last Updated” date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

8. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-laws rules. The uniform UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

If you are a consumer with your habitual residence in the European Union, you retain the protection afforded to you by the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings before the courts of that country. For all other disputes, the courts of Germany shall have jurisdiction. This is without prejudice to any mandatory rules on jurisdiction under Regulation (EU) No. 1215/2012 (Brussels Ia).
